Call for Applications for Three Positions as Members and Three Positions as Alternate Members of Schienen-Control
Pursuant to Section 82(3) of the Railway Act of 1957 (EisbG), the three members and the three alternate members of Schienen-Control are to be appointed for a term of five years. Following the expiration of the current term, appointments are required for a term running from January 1, 2027, to December 31, 2031. Reappointments of current members and alternate members are permitted. We are seeking candidates for the three positions for members and the three positions for alternate members of Schienen-Control .
A member to be appointed and the alternate member to be appointed for that member must be members of the panel of judges.
The remaining members and alternate members to be appointed must be experts in the relevant fields of transportation or in other network-related fields (Section 82(1) of the EisbG).
They may not be members of the federal government or a state government, nor may they be state secretaries; nor may they be persons who have a legal or de facto close relationship with those who make use of the services of Schienen-Control , or persons who are ineligible for election to the National Council (§ 82(2) EisbG).
The members and alternate members to be appointed must always act independently of any market interests relating to the railway sector; they may not hold any interest in railway infrastructure companies, allocation bodies, charging bodies, holders of infrastructure capacity, or operators of service facilities, and may not have any legal business relationship with railway infrastructure companies, allocation bodies, charging bodies, holders of track capacity, or operators of service facilities; this does not apply to the conclusion of contracts for the transportation of themselves, their luggage, or their goods (Section 82a(1) of the Railway Act).
The members and alternate members to be appointed must submit to the Federal Government, on an annual basis, a declaration in which they commit to complying with the requirements set forth in § 82a(1) of the EisbG, as well as a declaration of interests in which they must disclose any direct or indirect interests that could be viewed as compromising their independence and that could influence the performance of their duties on the Schienen-Control (Section 82a(2) of the EisbG).
Former members and alternate members may not hold a professional position or perform professional duties at rail transport companies, rail infrastructure companies, allocation bodies, charging agencies, or operators of service facilities for a period of at least one year after their membership in the Schienen-Control has expired (Section 82b of the Railway Act).
For their participation in meetings of the Schienen-Control , the members and alternate members to be appointed are entitled to reimbursement of reasonable travel expenses and out-of-pocket expenses, as well as an attendance allowance (Section 85 of the EisbG). The amount of the attendance allowance is determined in accordance with the 2023 SchiCKomm Attendance Allowance Regulation.
Appointments are made for the term of office from January 1, 2027, through December 31, 2031.
Applications must be submitted by August 4, 2026, at the latest, to “e1@bmimi.gv.at” or in writing to the Federal Ministry of Innovation, Mobility, and Infrastructure, Department IV/E1, Radetzkystraße 2, 1030 Vienna. Documentation proving that the appointment requirements have been met must be included.
