Complaint to the Schienen-Control

Entities entitled to track capacity, in particular rail transport companies, may lodge a complaint with the Schienen-Control if:

  • a procedure for monitoring competition* is to be initiated (Railway Act ยง 74)

  • a route request has been rejected by an allocation agency

  • access to service facilities or services was denied

  • no agreement has been reached within the time limits specified in the Railway Act (Sections 72, 73)

*In proceedings to monitor competition pursuant to Section 74 of the Railway Act, the Schienen-Control may, for example, investigate whether rail network usage conditions or contracts contravene regulatory law or whether the conduct of an allocation body, a charging body, a railway infrastructure company, or an operator of a service facility violates regulatory law.
