Appeal dismissed due to lack of jurisdiction

A freight forwarding company lodged a complaint with the Schienen-Control against a rail transport company that had previously handled transport for the freight forwarding company. The rail transport company refused to accept further orders for transport services. The Schienen-Control rejected the complaint on the grounds that the freight forwarding company does not itself participate in the rail transport market and is therefore not entitled to lodge a complaint.
