Declaration of invalidity of a provision in the terms and conditions for use of the rail network
In its decision of May 22, 2024, the Schienen-Control declared invalid a provision in the rail network usage conditions that excluded locomotive manipulation and wagon technical handling for ad hoc train paths on working days at a transport station. The Schienen-Control found that capacity for locomotive manipulation and wagon maintenance is available and is regularly allocated by the railway infrastructure company. The exclusion was therefore not objectively justified.
