Schienen-Control Kommission

The Schienen-Control Kommission is an independent administrative authority. It is part of Schienen-Control GmbH. The chairman and his deputy must belong to the judiciary. The other members are experts from the fields of technology and economy. All members are appointed by the Federal Government upon recommendation of the Federal Ministry for Climate, Environment, Energy, Mobility, Innovation and Technology (BMK).

The Schienen-Control Kommission is obliged to apply the General Administrative Act (AVG) as is Schienen-Control GmbH.

The tasks of the Schienen-Control Kommission comprise the following main topics:

  • Competition Regulation:  ex-officio procedures and procedures based on complaints from railway operators with access authorisation 
  • Declaration of invalidity of reimbursement conditions pertaining to the reimbursement of fares
