The Schienen-Control Kommission is an administrative authority bound by any instructions which is part of Schienen-Control GmbH. The chairman and his deputy must belong to the judiciary and are appointed by the Federal Ministry of Justice. The other members are experts from the fields of technology and economy: they are appointed by the Federal Government upon the recommendation of the Federal Ministry for Transport, Innovation and Technology.
The Schienen-Control Kommission is obliged to apply the General Administrative Act (AVG) as is Schienen-Control GmbH.
The tasks of the Schienen-Control Kommission comprise the following main topics:
- Competition Regulation: ex-officio procedures and procedures on the basis of complaints from railway operators with access authorisation
- Declaration of invalidity of reimbursement conditions pertaining to the reimbursement of fares
